1. General
1.These General Conditions apply to all products in the web shop of DaLìQue
2.In addition to these General Conditions, Additional conditions may apply to certain products if expressly indicated
3.If you, as a buyer, request the delivery of one ore more products from the seller (hereafter DaLìQue), then this is considered to be a legally binding agreement (remote sale).
4.By using the DaLìQue website and/or placing an order, you accept these General Conditions as well as any other rights and obligations that may be mentioned on this website.
5.Because the colors of our products are displayed in different ways, based on screen settings and capacities, we cannot guarantee that color deviations will never occur.

2. Orders
1.All offers of DaLìQue are without obligation. DaLìQue expressly deserves the right to change the prices, especially when this is required based on (legal) requirements.
2.An agreement shall only be established after you, as a customer, accept the offer on our website. DaLìQue has the right to refuse orders or to request additional information. If an order is not accepted, you will be notified of this with mention of the reason.
3.After an order you’ll receive a confirmation e-mail as soon as possible. This e-mail includes the purchase amount of our product(s) + any shipping charges. This confirmation also serves as your invoice. If, after placing an order, you have not received a confirmation, you can notify our customer service by sending an email to info@DaLìQue.com.
4.Offers are valid while stocks last and during the indicated period

3. Cancelling
1.Every order can be cancelled, free of cost, within 24 hours after the order is placed. Cancelling is only possible through e-mail to our customer service info@DaLìQue.com.

4. Prices
1.All prices indicated are in Euro’s (€).
2.All prices are VAT inclusive and exclusive of any shipping costs, unless indicated otherwise in the information that applies to the article. If you are not located in the Netherlands, you are responsible for any sales tax and / or import duties due.
3.The listed prices are just an indication. Exact prices are only displayed when you place an article in the shopping cart.
4.DaLìQue cannot be held to price listings that are incorrect due to errors in entry, typographical errors or misprinting. No rights can be derived from erroneous price information.

5. Payment options
1.Orders plus shipping costs must be paid in advance. Payment occurs through PayPal and iDeal, Visa or MasterCard by way of payment provider Buckaroo online payment services. Payment needs to be approved by PayPal and Buckaroo at all times, before DaLìQue will proceed to deliver. The Buckaroo online payment services have excellent protection against any fraud. 6. Shipment
1.We send all orders through parcel ware mail of TNT Post. By using parcel mail, we limit the risk of loss, damage or theft during the transport of your order.
2.The shipping costs are * with the Netherlands: € 5, -
3.For an order above € 100,- no shipping costs are charged in the Netherlands

* for shipments to other countries than the Netherlands, the charge depends on the specific country. You can obtain information n on the costs of delivery through https://securepostplaza.tntpost.nl/ or an e-mail to info@DaLìQue.com.


7. Delivery
1.All products are offered to TPG Post within about 3 workdays after receipt of payment. We strive to offer it as soon as possible.
2.If products have a longer delivery time than 5 workdays, we will notify you trough e-mail.
3.In case any article becomes unavailable, you will be notified of this through e-mail. You then have the possibility to cancel your order or to order replacement article for the same amount as your order.
4.Shipment occurs under the ‘Algemene Voorwaarden voor Opgedragen Postvervoer van TNT’ which are mentioned in the General Conditions of TPG.
5.You can track your package through Track&Trace at https://securepostplaza.tntpost.nl/tracktrace/. After shipment of your package, you will receive a shipping confirmation from us through e-mail. This e-mail includes a Track&Trace-number. With this number, you can track your package online. This applies to all orders within the EU.
6.After to delivery attempts the package can be picked up at the post office for a period of three weeks. If the package is not picked up within three weeks, the package will be returned to us. We will then reimburse the purchase amount minus any shipping costs, to the account number provided by you.

8. Returning and exchange
1.In principle, you can return the articles ordered by you without providing any reason. There are a few conditions to this however:
* You have notified us, exclusively through e-mail to our customer service return@DaLìQue.com, of the fact that you are returning one or more products, within 7 days after receipt of your order.
* After receipt of you e-mail, you’ll receive a return number from us, and you need to return the product(s) within 3 workdays.
* the articles need to be returned in the original state, meaning, unworn, unwashed, intact, provided with attached cards and in the original packaging.
* Discounted articles cannot be returned.

2.with mention of the return number
* The shipping costs for your return shipment are at your own expense unless a mistake was made by DaLìQue. Return shipments need to be sufficiently stamped at all times, insufficiently stamped return shipments are NOT accepted and therefore NOT credited.
3.If you meet the before mentioned requirements, the purchase amount and any shipping costs are reimbursed within 14 workdays after receipt of your return shipment, to the bank account number provided by you. DaLìQue exclusively accepts returns that are registered using the above described method and for which the instructions indicated during the registration, are followed. Returns that have not been registered or not registered within the determined period are not accepted. Incorrect return shipments are returned back to you with deduction of shipment costs. For return shipments within the Netherlands, we charge € 4,95 for the shipment and for return shipments outside of the Netherlands we charge higher shipping costs.
4.Discounted articles can NOT be exchanged. Underwear and swim wear can NOT be returned or exchanged for hygienic reasons.

9. Stock
1.The stock of the web shop is updated real-time. If in any case the product ordered by you is no longer in stock, DaLìQue will notify you of this as soon as possible. You then have the right to cancel the order of the missing article without any cost or to order replacement articles for the same order amount. In case of cancellation, DaLìQue will reimburse the amount to the bank account number provided by you, within 14 workdays.

10. Compensation of damage
1.Any liability of DaLìQue and of the employees and products of DaLìQue for all damage of whichever kind, directly or indirectly, including company damage, consequential damage, damage to movable or immovable goods or to individuals is hereby exclusively rejected. Nor is DaLìQue liable to the damage that is caused in the implementation of the agreement by third parties.
2.DaLìQue accepts no liability to any damage arising from the use of DaLìQue products.
3.Any liability of DaLìQue is in any case limited to the highest invoice amount due to DaLìQue under the specific agreement.
4.For misunderstanding, delay or improper delivery of the orders and notifications caused by the use of internet or any other means of communication in the traffic between you and DaLìQue or between DaLìQue and third parties to the extent applicable to the relationship between you and DaLìQue, DaLìQue is not liable unless and insofar intent or gross negligence of DaLìQue can be proven.

11. Force Majeure
1.In case of Force Majeure, DaLìQue has to right to, at its own choice, suspend the execution of your order or to terminate it without judicial intervention, by providing you with a written notice of this and without being liable to any damages, unless this would be unacceptable with respect to reasonableness and fairness under the given circumstances.
2.Force Majeure means: any shortcoming that cannot be attributed to DaLìQue because it is not due to her fault and to which she is not accountable under Law or legislation or generally accepted trade practices. These circumstances also include strikes, fire, business disruptions, power disruption, non, or non-timely delivery of suppliers or other enabled third parties. In addition, Force Majeure includes. Disruptions in a (telecommunication) network or connection or used communication systems and / or the unavailability of the website at any time.

12. Privacy
1.Any personal information will strictly be used by DaLìQue and will not be provided to third parties, unless required for payment transactions and delivery of the order.

14. Applicable Law
1.To all agreements partly of fully under these conditions, Dutch law exclusively applies.
